Order of Business

1. Call to Order and Roll Call.  The Landmark Tree Committee meeting convened at 4:20 p.m.
Present:  Chair Hillson, Members Costello, and Hillan; Absent:  Member Buck; Excused:  Member Sutherland.

2. Approval of Minutes of the December 6, 2012 Urban Forestry Council Landmark Tree Committee Special Meeting (Explanatory Document: December 6, 2012 Draft Minutes) (Discussion and Action)

Upon motion by Member Hillan, second by Member Costello the December 6, 2012 Meeting Minutes were approved with amendments (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland) (Explanatory Document:  December 6, 2012 Approved Minutes). 

3. Review and Approval of Proposed Amendments to the Draft Landmark Tree Nomination Form approved by the Urban Forestry Council on August 28, 2012 for Recommendation to the Urban Forestry Council. (Explanatory Documents: Amended Landmark Tree Nomination Form, Proposed Amendments by Member Costello, and Resolution )  Sponsor:  Member Costello (Discussion and Action)

The Committee unanimously approved edits to the Draft August 28, 2012 Landmark Tree Nomination Form for recommendation to the Urban Forestry Council to consider at its January 25, 2013 meeting. (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland) (Explanatory Document:  Amended Draft January 6, 2013 Landmark Tree Nomination Form)

The Committee unanimously approved edits to the Landmark Tree Nomination Form Resolution File No. 2012-03-UFC (003-12-UFC) for recommendation to the Urban Forestry Council for consideration at its January 25, 2013 meeting.  Draft Resolution File 2013-01-UFC will supersede Resolution File 2012-03-UFC recommending amendments to the Landmark Tree Nomination Form.  

Public Comment:  Ms. Dee Seligman asked if the process of approving the forms would take a while.  Members of the Committee responded that it may take some time – months or more to be completed due to legal sign-offs and Board of Supervisors approval as well as possible other hurdles along the way.

4. Review and Approval for recommendation to the Urban Forestry Council of (1) Proposed Amendments to Public Works Code Landmark Tree Ordinance Sections 802 and 810 to add ‘Grove’ Language; (2) Amended Landmark Groves Selection Definition and Criteria, and (3) Amended Landmark Grove Nomination Form. (Continued from the December 6, 2012 Meeting)(Explanatory Documents:  Proposed Amendments to Public Works Code Landmark Tree Ordinance, Article 16, Sections 802 and 810; Amended Landmark Groves Selection Definition and Criteria; Amended Landmark Grove Nomination Form. (Discussion and Possible Action)

Upon Motion by Member Hillan, second by Member Costello, the Committee unanimously approved the December 6, 2012 proposed amendments to Public Works Code Chapter 16, Landmark Tree Ordinance Sections 802 and 810 to add ‘Grove’ language with no revisions for recommendation to the Council for consideration at its January 25, 2013 meeting. (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland)

The Committee unanimously approved the October 4, 2012 Landmark Groves Selection and Criteria with no revisions for recommendation to the Council for consideration at its January 25, 2013 meeting. (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland)

The Committee unanimously approved the Landmark Grove Nomination Form with amendments for recommendation to the Council for consideration at its January 25, 2013 meeting. (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland) (Explanatory Document:  January 6, 2013 Amended Landmark Grove Nomination Form)

Public Comment:  Ms. Dee Seligman inquired about temporary landmark designations in Section 810(4)(d)(1) and (2). She discussed the limitations associated with the nomination and approval process for landmark groves and the ability to nominate a grove being limited only to property owners.  She said there was a different level of efficacy by the stated nominators of landmark groves than a property owner or a renter.  She suggested that the form should allow landmark groves to be nominated by any city resident and the person should be able to nominate a grove that may not be on the person’s private property without the gateway of the nominators listed on the form.  She said the Landmark Grove Nomination Form restricts the process and prohibits individuals from proposing landmark (grove) status – what public agencies can do -- is unfair and creates a domino effect. 

Ms. Seligman also mentioned that, in response to Member Hillan’s remark that the Landmark Tree Nomination Form is the model for the Landmark Grove Nomination Form and is not anything new as far as having to go through these nominators, Ms. Seligman stated that the choice is still in the public agency’s hands if the residents want landmarking.  She also mentioned in response to Member Hillan’s explanation of a management plan for the landmark groves, that the public agency will be tasked to manage the grove and finances may not be there especially after she attended Supervisor Wiener’s meeting on Department of Public Work’s tree relinquishment hearing and how Recreation and Park Department is only assessing and pruning every 50 years vs. 10-15 years.  She also inquired who would be handling resolution of a grove landmarking issue if not at the Landmark Tree Committee and the full Council it was stated that it would go to the Board of Supervisors.  She said there will be a domino effect from this. 

5. Prepare and Approve Draft Resolution Adopting Documents in Items 3 and 4 for Recommendation to the Urban Forestry Council. (Explanatory Documents:  Draft Resolution 2011-07-UFC and Cover Letter to the Board of Supervisors) (Discussion and Action)

The Committee prepared and approved Draft Resolution File 2013-02-UFC to recommend amendments to Article 16, Section 810 of the Public Works Code to the Board of Supervisors.  This Resolution supersedes Urban Forestry Council Resolution File 2011-07-UFC (007-11-UFC) that the Council adopted on August 28, 2012.  The Committee unanimously approved the Cover Letter to the Board of Supervisors with amendments (Explanatory Document:  Amended Draft Resolution File 2011-07-UFC 2013-02-UFC and Amended Cover Letter) (AYES:  Members Hillson, Costello and Hillan; Absent:  Members Buck and Sutherland).

6. New Business/Future Agenda Items. (Information and Discussion) Member Hillan announced that he will not be renewing his application to serve on the Urban Forestry Council.

7. Public Comment:  Members of the public may address the Committee on matters that are within the Committee’s jurisdiction and are not on today’s agenda.

Public Comment:  Ms. Dee Seligman thanked Committee Members for the opportunity to address the group and helping her think through the landmark groves issues and potential domino effect.  She asked whether her comments will be forwarded on to the full Council since they would be in the minutes or if she could attend the full Council meeting.  She was told the time of the next full Council meeting scheduled for January 25, 2013, 8:30am and/or she could communicate with Ms. Monica Fish, the Commission Secretary with additional input.  The two students observing a municipal meeting in action for school credit also nodded along with Ms. Seligman.

8. Adjournment.  The meeting adjourned at 5:27 p.m.
