Notice of Public Hearing Regarding Regulations
Governing Enforcement of Chapter 14 of the San Francisco Environment Code

Monday, February 6, 2023, at 2:00 p.m.

Remote meeting via web conference

This hearing will be held remotely without providing a physical location. Members of the public may observe the hearing and provide public comment online.

AUTHORIZATION
San Francisco Environment Code Chapter 14, Section 1410

A law amending the Construction and Demolition Debris Recovery Ordinance (No. 144-21) was signed by the Mayor on September 24, 2021, and became effective on January 1, 2022. The ordinance amends Chapter 14 of the Environment Code as amended now:

a. Requires transporters of construction and demolition debris to obtain a temporary or annual permit from the Environment Department ("SFE") for each vehicle and debris box used for such transport and to comply with permit conditions;

b. Establishes authority for the Director and their respective designee(s) to inspect the premises, equipment, and records of any permitted Transporter with the consent of the owner or with a proper inspection warrant; and

c. Authorizes the Director to impose administrative penalties for violations.

The Director of SFE promulgates these regulations and associated forms under the authority granted in section 1410 of the Environment Code to adapt regulations, guidelines, and forms as necessary and appropriate to implement Chapter 14 of the Environment Code.

During the hearing, members of the public will have the opportunity to comment about the proposed regulations. Persons unable to attend the hearing may submit to the Environment Department, by the time the hearing begins, written comments. These comments will be made a part of the official public record and shall be brought to the attention of the Department. Any written comments should be sent to [email protected].

Participating During Public Comment

Members of the public will have opportunities to participate during public comment. The public is asked to wait for the particular agenda item before making a comment on that item. Comments will be addressed in the order they are received. When the hearing officer announces that public comment will begin, members of the public can:

  • Participate over the phone by pressing *3 (this step is very important, as it will activate the “Raise Hand” icon in the Participant window).

Depending on the number of people also in line ahead of you, you may have to wait before it is your opportunity to speak. When it is your turn, you will be notified that your line has been unmuted, and it will be your opportunity to speak. Your line will be muted again when your allotted time expires.

Public Comment

Public comment will be taken on each item before or during consideration of the item. Each member of the public may address the hearing for up to three minutes, unless otherwise announced by the hearing officer. If it is demonstrated that the comments by the public will exceed 15 minutes, the hearing officer may continue Public Comment to another time during the meeting.

Language Access

Per the Language Access Ordinance (Chapter 91 of the San Francisco Administrative Code), Chinese, Spanish and or Filipino (Tagalog) interpreters will be available upon requests. Meeting Minutes may be translated, if requested, after they have been adopted by the Commission. Assistance in additional languages may be honored whenever possible.
